5 Steps to Prepare for EU AI Act Compliance

Most SME teams do not fail EU AI Act compliance because they do not care. They fail because work starts too late, ownership is unclear, and legal guidance is not converted into operations.

The good news: you do not need a giant compliance department to be ready. You need a disciplined sequence built around real obligations in Regulation (EU) 2024/1689.

This five-step framework is designed for practical execution across product, legal, operations, and leadership.

Step 1 — Build an AI inventory that reflects reality

Compliance starts with visibility. If you cannot list your AI-enabled workflows, you cannot classify or control them.

At minimum, capture for each use case:

  • System/workflow name
  • Business owner
  • Purpose and decision point
  • Input data categories
  • Output type (recommendation, score, generation, automation)
  • Who is affected (customers, applicants, employees, students, etc.)
  • Vendor/model dependencies
  • Current controls and known gaps

Why this matters legally:

  • Role and obligation mapping depends on factual use, not vendor marketing.
  • Deployer recordkeeping expectations are tied to operational use context.

Practical tip: inventory by use case, not by tool license. One tool can support many use cases with different risk levels.

Inventory quality checklist

  • Is every entry mapped to an accountable owner?
  • Can non-technical teams understand the use-case description?
  • Is there a last-reviewed timestamp?
  • Are change triggers defined (new feature, new market, new data source)?

If not, fix this before moving on.

Step 2 — Classify risk using Article 5 + Article 6/Annex III

Once you have visibility, classify each use case.

A) Prohibited-practice screen (Article 5)

Run a red-flag check first. If a use case maps to prohibited categories, design alternatives immediately. Do not continue rollout while "figuring it out later."

B) High-risk screen (Article 6 + Annex III)

For remaining use cases, assess whether context aligns with Annex III domains. If yes, treat as high-risk candidate and trigger stricter controls.

C) Transparency obligations (Article 50)

Some use cases are not high-risk but still require clear disclosure (e.g., AI interaction and synthetic content contexts). Add product/UI tasks accordingly.

D) Role mapping (Article 3 definitions + Article 25 shift risk)

Map whether your organization is deployer, provider, importer, distributor, or mixed. Re-check when product strategy changes (white-labeling, substantial modification, repurposing).

Document classification rationale in writing with article references. "Team consensus" without traceable reasoning is fragile.

Step 3 — Implement minimum viable controls aligned to Articles 9-15

If a use case is high-risk (or likely high-risk), you need operational controls now.

1) Risk management process (Article 9)

Set a repeatable risk lifecycle: identification, assessment, mitigation, monitoring, review.

2) Data and governance quality (Article 10)

Define data quality expectations, known limitations, and remediation routes.

3) Technical documentation (Article 11 + Annex IV)

Create practical documentation that explains system purpose, limits, deployment assumptions, and evidence.

4) Logging and traceability (Article 12)

Log decision-relevant events, model versions, intervention actions, and incident traces.

5) Transparency/instructions (Article 13)

Give operators and affected users understandable instructions and disclosures.

6) Human oversight design (Article 14)

Define who can intervene, what triggers intervention, and how overrides are recorded.

7) Accuracy/robustness/cybersecurity baseline (Article 15)

Set measurable thresholds and escalation rules when performance degrades or incidents occur.

You do not need to perfect every control in one sprint. You do need a live baseline with owners and deadlines.

Step 4 — Build an evidence package before you need it

Evidence turns policy into credibility. Without evidence, even good intent looks unprepared.

Your initial package should include:

  • Current AI inventory export
  • Classification register with Article 5/6/Annex III/50 references
  • Role map (provider/deployer/etc.)
  • Oversight and escalation SOPs
  • Logging and incident process description
  • Control owner matrix
  • Training/awareness records (including AI literacy under Article 4)
  • Open-gap remediation tracker

Keep this package versioned and easy to retrieve. A good target: shareable within 24-48 hours for audit/procurement requests.

Step 5 — Run compliance as an operating rhythm, not a project

The most common failure mode is "one-time compliance push" followed by drift.

Set cadence:

  • Monthly: inventory updates + new-use-case classification
  • Quarterly: control effectiveness review + incident trend analysis
  • Event-driven: immediate reassessment after model, data, or process changes
  • Annual: policy refresh + training updates

Track KPIs that matter:

  • % of AI use cases with current owner + classification
  • Number of high-risk candidates without complete control baseline
  • Mean time to close AI control gaps
  • Oversight intervention frequency and outcomes
  • Incident detection/resolution time

How to keep momentum when teams are small

SMEs often pause compliance work because urgent product deadlines take over. To prevent stalls:

  • Time-box a weekly 45-minute AI governance standup
  • Require one measurable deliverable per week (e.g., 5 workflows classified, 1 SOP published)
  • Keep a visible gap tracker with due dates and owners
  • Tie unresolved high-risk gaps to release gating for sensitive features

This converts compliance from a side project into normal delivery hygiene.
