Factors That Affect Your Actual Fine (Article 99(7))

Regulators consider these when determining penalties:

• Nature, gravity, and duration of the infringement
• Whether other authorities have already fined for the same violation
• Size, annual turnover, and market share of the operator
• Financial benefits gained or losses avoided from the infringement
• Degree of cooperation with authorities
• Technical and organisational measures taken to comply
• How the infringement became known to authorities (self-reported vs discovered)
• Whether the infringement was intentional or negligent
• Actions taken to mitigate harm to affected persons

For SMEs: Article 99(6) caps fines at the lower of the flat amount or percentage of turnover. For large enterprises, the higher amount applies.
